Service Privacy Policy

I. Preliminary information 

 

     1. Tubądzin Management Group Sp. z o.o. with its registered office in Cedrowice-Parcela respects everyone's fundamental right to privacy. Tubądzin Management Group Sp. z o.o. attaches particular importance to ensuring confidentiality and protection of personal data processed by it, and makes every effort to ensure that the processing of such data is compliant with the provisions of law, and respects the fundamental rights and freedoms of the persons to whom the data pertains.

     2. This privacy policy of the www.b2b.tubadzin.pl website (hereinafter referred to as the "Website") sets out the principles for the collection, processing and use of personal data, as well as information about the cookies used on the Website.

     3. The Controller of the personal data collected through the Website is "Tubądzin Management Group" Sp. z o.o. with its registered office in Cedrowice-Parcela (address: Cedrowice-Parcela 11, 95-035 Ozorków), entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Łódź-Śródmieście in Łódź, XX Commercial Division of the National Court Register under KRS number 0000286217, NIP 732-20-83-952, REGON 100383200, e-mail: tubadzin@tubadzin.pl, (hereinafter: "Controller").

     4. The Controller has appointed a Data Protection Officer who can be contacted by email at iod@tubadzin.pl.

     5. The term "User" shall mean, depending on the context, a person using the services provided by the Controller or a person wishing to use these services or an Internet user accessing the Website.

 

II. Personal data processing 

 

     1. Personal data on the Website are processed by the Controller in accordance with generally applicable legislation, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council as of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the freedom of movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: "GDPR").

     2. The personal data provided by the User while using the Website may be processed, in particular through a dedicated registration form:

                 a) in order for the User to make a registration application to the Website - a b2b platform enabling cooperation with distributors, wholesalers and showrooms, as well as placing orders directly from Tubądzin Group warehouses,

                 b) in order to enable registered and approved users to use the services offered at the Website, especially placing orders and access to personal data and account history,

     3. Providing personal data is voluntary, but necessary to fulfill the purposes specified above.

     4. Personal data will be processed for the period of activity of the user's account in the Service, and after that time - in the scope and for the period of limitation of claims; in the case of data processing for the purpose of direct marketing of own products - until objection to their processing is made, and after that time - in the scope and for the period of limitation of claims;

     5. The User has the right to access his/her personal data and the right to rectify, erase and restrict their processing, as well as the right to object to the processing of the data carried out on the basis of legally justified purpose of the Controller. Detailed rules for exercising the above rights are indicated in Articles 15-21 of the GDPR.

     6. The User has the right to lodge a complaint if they consider that the processing of data by the Personal Data Controller violates the provisions of the GDPR.

     7. For the proper functioning of the Website it is necessary for the Controller to use the services provided by external entities. The Controller only uses the services of such processors who provide sufficient guarantees to implement appropriate technical and organisational measures so that the processing meets the requirements of the GDPR and protects the rights of data subjects.

     8. Data collected within the Service may be transferred to entities entitled to obtain them under applicable laws; this applies in particular to law enforcement agencies.

     9. Information on certain users' activities is subject to logging at the server layer. This data is used exclusively for the administration of the website and to ensure the most efficient operation of the hosting services provided. The accessed resources are identified by URL addresses. In addition, the following may be recorded:

  • time of arrival of the request,
  • time of sending the response,
  • the name of the client station - identification via the HTTP protocol,
  • information about errors which occurred during the HTTP transaction,
  • the URL address of the website previously visited by the user (referer link), in the event that the website was accessed through a link,
  • information about the user's browser,
  • information about the user's IP address.

The above-mentioned data are not associated with specific users and are used only for the purposes of server administration.

 

III. Cookie policy  

 

     1. In respect of the use of the Website, "cookies" are collected.  Cookies are computer data stored as text files which may contain personal data in the form of IP address and unique device identifier stored in the file. Cookies are stored on the Website User's terminal equipment and enable use of individual functions of the Website; these are used to improve usage of the Website. Cookies usually contain the name of the website they come from and a unique number.

     2. Cookies are used in order to:

                 a) adjust the content of websites to the User's preferences and optimise the use of websites; in particular, these files allow the Website User's device to be recognised and the website to be properly displayed, adjusted to the User's individual preferences;

                 b) create statistics which help understand how users of the Website use websites, which makes it possible to improve their structure and content;

 

     3. The Website uses the following types of "cookies": "session cookies" (temporary files that are stored in the User's terminal equipment until leaving the website or switching off the web browser), "permanent cookies" that are stored in the User's terminal equipment for the time specified in the parameters of the cookies or until they are deleted by the User.

     4. The legal basis for the collection of personal data read from "cookies" is Article 6(1)(f) of the GDPR allowing the processing of personal data for the purposes of carrying out a legitimate interest of the Data Controller. Such purpose is to adjust the Website to the User's individual settings and to save the data entered by the User related to the use of the Website, as well as to conduct statistical and analytical analyses related to the Users accessing the Website and to operate social plug-ins.

     5. Users may at any time change their settings related to "cookies". These settings can be changed, in particular, in such a manner as to block the automatic handling of cookies in the settings of the web browser or inform on their placement in the device each time.

     6. Service User. Detailed information on the possibility and methods of using cookies is available in software settings (web browser).

     7. Users have the right to delete data obtained through cookies, to object to their processing, as well as the right to lodge a complaint with the Office of the Polish Data Protection Commissioner as the supervisory authority.
